<p>This course covers Code of Ethics issues throughout the contract while giving the learner a knowledge of issues which are part of everyday transactions.  REALTORS(R) will get Code of Ethics credit towards their next quadranniel NAR requirement.  We notify SVVAR, or your local association.</p>
<p><strong>Friday, May 17</strong>, Fair Housing &#8211; Gender   Noon-3PM  3 hours Fair Housing</p>
<p>This is such a great class on Fair Housing but focusing on Gender (women) issues.  We go back to times BC and follow the plight of women throughout history&#8230;their right to vote, to be treated equally to men, have control over their lives, and how their suffrage movement ran parallel to the Civil Rights movement&#8230;each movement augmented the other.  We openly discuss how women have been kept from obtaining loans, housing, credit, and job issues.  We talk about being single with a child &#8211; when fair housing goes from just being to a woman to being a woman with a child looking for housing.  Fair Housing is for everyone!!</p>
<p><strong> Friday, May 17</strong>, <a title="Does “As Is” Mean “No Seller Repairs”?" href="http://how2educate.com/2011/05/15/does-%e2%80%9cas-is%e2%80%9d-mean-%e2%80%9cno-seller-repairs%e2%80%9d/">Is &#8220;As Is&#8221; Just About Repairs?</a>  3PM-6PM  3 hours Disclosure</p>
<p>When the seller says, &#8220;I&#8217;m not going to pay for any repairs&#8221; do you say &#8220;well, let&#8217;s just have all offers include an &#8220;as is&#8221; addendum&#8230;?  Question:  What does an &#8220;as is&#8221; addendum say to a potential buyer?  Red Flag!   Come learn what all the &#8220;as is&#8221; addendum really says&#8230; depending on whether you are wearing your Listing Agent hat or your Buyer Agent hat, you may want to rethink the merits of an &#8220;as is&#8221; addendum.  Fun class.  We&#8217;ll actually take a scenario, have a listing agent and a buyer&#8217;s agent and we&#8217;ll see how the &#8220;as is&#8221; addendum affects the transaction.</p>
<p><strong>Saturday, May 18</strong>  Legal Issues &#8211; Potpourri   9AM-Noon  3 hours Legal Issues</p>
<p>A great class that covers Copyright Law, FIRPTA, Mediation, Landlord-Tenant, and more.  It&#8217;s a great class for talking about many things we don&#8217;t learn in other classes, but we do it by touching the highlights rather than spend 3 hours on each topic.  For example:  Kathy Howe is handling more and more landlord-tenant mediations for the court.  We&#8217;ll discuss how the law and mediation work together for a win-win.</p>
<p><strong>Saturday, May 18</strong>  Agency &#8211; the 26th Amendment   Noon-3PM  3 hours Agency</p>
<p>Agency and agency fiduciary duties.  A history of the importance of the 26th amendment to the Arizona Constitution.  How your agency influences the decision your clients make in the transaction.</p>
<p><strong>Saturday, May 18</strong>  List &amp; Lease to Last   3PM-6PM  3 hours Contract</p>
<p>This course focuses on the listing employment agreement as the basis to your real estate business.  We discuss what makes for a good agreement, the agency issues NOT found in the SVVAR agreement and how to remedy it, we discuss the READE form, and the Limited Dual Agency form.  Then we discuss rentals and lease agreements.</p>
<p><strong>Wednesday, May 22</strong>:  Broker Management Clinic day.  9AM to 6PM  Commissioner&#8217;s Standards</p>
<p>Get all 3 Broker Management Clinics in one day.  These continuing education classes are great for licensees as well, especially BMC #1 which focuses on the Statutes and the Rules and BMC #3 which focuses on broker leadership and supervision.  BMC #2 is about Office Policies and how to develop them.  Call Kathy if you only want to take one of these.</p>

<p>This class goes into the statutes and rules of being a real estate licensee and how to use the positive side of these statutes and rules to develop a thriving real estate business.</p>

<div>I cannot remember when I actually met Judy Lowe…some time in the late ’80s or early ’90s.  I admired her then</div>

<p>…and I admire her now.</p>
<p>Yesterday (8-27-09), though sleep-deprived and a desk that still looks like Mt. Kilimanjaro, I drove down to the ADRE’s Education meeting.  The invites had gone out to real estate schools and instructors throughout the state.  As a school, and an advocate of education, I felt I could not miss this opportunity to hear more about the ADRE’s future plans.</p>
<p>For those of you who have not realized that there is a new and different “sheriff in town”, you need to pay attention.  Here are some changes that will take place, “in time” and with the help of industry partners:</p>
<ul>
<li>return to a 2 year license renewal structure</li>
<li>prelicensure and then a provisional license (both salesperson and brokers)</li>
<li>test questions will be changed and unique to salespersons and brokers</li>
<li>assessments for schools, courses, and instructors (moderate-reasonable)</li>
<li>easy “education” audits (easier with transaction management platforms)</li>
<li>and more…</li>
</ul>
<p>Understand these will need to be packaged into an Omnibus bill from the ADRE and submitted to the Legislature and passed into law.  The interesting point of all of this is the different direction of this Real Estate Commissioner versus the previous Commissioner, Sam Wercinski.  Different focus.  Different energy and resources.  Different priorities.</p>
<p>You need to pay attention.  The new sheriff believes in doing things accurately, specifically, and is not afraid to punish.  The way to stay out of trouble with this new regime is to educate yourself on all the minute ways to get into trouble, and then avoid the pot holes.</p>
<p>Education will be the keynote in anything this Commissioner says.  She lives and breathes professionalism through education.  And if that doesn’t work, she has a gun.</p>

<p>Today, 4 years later, the words resound.</p>
<div>Not what she wanted to do on that day in 2009, she has changed her direction.</div>

<div>The most recent issue is an ADRE alert that went out saying it was MANDATORY that all Designated and Associate Brokers with authority to do Designated Broker duties MUST respond to a survey that mostly covered whether or not you were doing property management, did you have a trust account, did you have E&amp;O insurance, a surety bond, branch offices&#8230;</div>

<div>There are rumors that the Commissioner wants to know what Associate Brokers are doing Broker delegated duties to be sure they have taken the 9 hour Broker Management Clinic training.  It&#8217;s all required of these parties now, but this Commissioner does not seem to trust that Brokers are following the rules.</div>

<div>She wants to know how many Brokers do Property Management and who has a Trust Account.  All of those things are in statute and rules, but again, the Commissioner does not seem to believe Brokers are following the rules.</div>
<div></div>
<div>She wants to know who has E&amp;O insurance and what Property Managers are bonded.  Rumor has that question tied to the Commissioner wanting all Property Management Brokers to have a mandatory bond and she wants to add it to her wish list for next year&#8217;s Rules package.</div>
<div></div>
<div>Instead of getting rid of archaic statutes and rules&#8230; like 14 day notice for educators to give to the Department of Real Estate in order to schedule a class.  This was deemed necessary years ago, during paper and pencil days, in order to allow the ADRE to send out a monitor to the class.  It includes prelicense classes, which they do not monitor.  Scheduling with a 14 day notice inhibits classes that could be given when a situation presents itself.  How does the 14 day notice protect the public?  The purpose of the Department is to protect the public.</div>
<div></div>
<div>Why not a survey to the  ADRE from the licensees and educators asking for things like the 14 day rule being eliminated?  What happened to working together for the good of the public?  Gone.</div>
<div></div>
<div>We learned that it took the Governor to tell the Commissioner the survey would not be mandatory&#8230; yet the Commissioner said she wanted all brokers to fill out the information and if brokers did not send in the survey, they would be sent additional requests for the information&#8230; I just got my 2nd survey, and I deleted it.</div>
<div></div>
<div>Many brokers are afraid of retaliation by the Commissioner.  The Commissioner says she won&#8217;t do any retaliatory audits.  We&#8217;ll see.</div>
<div></div>
<div>This Commissioner seems to want to use her gun instead of her &#8220;softer side&#8221; to get what she wants.  Sad.</div>
<div></div>

<p>Real estate agents work hard to help a buyer find a property.</p>
<p>Listing agents work harder to list and market a property.</p>
<h2><span style="color: #008000;">What is IDX?  INTERNET DATA EXCHANGE</span></h2>
<p>An <b>Internet Data Exchange</b> (IDX) is a real estate property search site which allows the public to conduct searches of approved multiple listing service properties in a certain area.</p>
<p>The &#8220;approved&#8221; means a listing broker approves of/allows a specific property to be reframed by other brokers and their agents for display on the internet.</p>
<p>Under Arizona rules and the REALTOR Code of Ethics, any broker who displays the listing of another broker, must disclose the name of listing/employing broker in all advertising.</p>
<p><strong>Arizona&#8217;s rule R4-28-502(E):  &#8221;A salesperson or broker shall ensure that all advertising identifies in a clear and <span style="color: #993300;">prominent manner</span> the employing broker&#8217;s legal name or the dba name contained on the employing broker&#8217;s license certificate.&#8221;</strong></p>
<p><strong>REALTOR Code of Ethics:  Standard of Practice 12-5.  REALTORS<sup>®</sup> shall not advertise nor permit any person employed by or affiliated with them to advertise real estate services or listed property in any medium (e.g., electronically, print, radio, television, etc.) without disclosing the name of that REALTOR<sup>®</sup>&#8216;s firm in a <span style="color: #993300;">reasonable and readily apparent manner</span>. </strong></p>
<p>The purpose for the disclosure is to ensure that the public not erroneously think the advertised property is listed by the agent who is displaying the listing.</p>
<p>In the Sedona Verde Valley Association&#8217;s MLS Rules, see Section 17.</p>
<p>Note:  Many of the Associations charge brokers a fee to IDX the listings of other brokers.</p>
<h2><span style="color: #993300;">Dilemma</span></h2>
<p>Those agents who want to attract buyers to their sites are avid fans of the IDX system.  But, the reality is that many of these agents are not familiar with the property the agent is advertising.  Many never have previewed it and may live many, many miles from the property.</p>
<p>A listing broker needs to consider the fact that calls on their properties may be going to agents who are not familiar with the property the buyer is calling on and that the buyer may be turned away from that property.</p>
<p>In and of itself, turning a buyer to another property may not be a bad thing.  That&#8217;s what a Professional does after listening to the wants and needs of a caller and realizing that the property they are calling on may not be what the caller is looking for.</p>
<p>Listing brokers need to decide if they want the IDX exposure.</p>
<p>Have calls on properties dropped significantly?</p>
<p>Are showings down?</p>
<p>Each listing can be individually pulled from IDX exposure by the listing broker.  Deny IDX exposure for a while and see if the phone calls and showings increase.</p>
<p>After all, listing brokers are hired to act in the best interest of their seller(s).  If the calls have decreased and the showings are down&#8230;</p>

<p><strong>PRELICENSE</strong></p>
<p>Our prelicense course is VERY different from the traditional prelicense training that others give.  Ours is a mixture of lecture and student independent study of the digital book we provide.  We test often and we test thoroughly, for the purpose of finding out where you need more work.  We encourage discussion and questions.  We have a library of books that are for student use, but must stay in the classroom.  We provide you with the Arizona Law Book in digital format &#8211; ours is current and up-t0-date (we even gave a copy to the ADRE education manager).  We provide you with a digital definitions list..  Kathy Howe has taught real estate prelicense for almost 2 years, now has her own course approved, has written her own digital, rule and statute based digital book, and study aids.</p>
<p>This type of learning is not for everyone, but if you are someone who knows how to study, wants to work at your own pace, may have interruptions that prevent you from taking every scheduled class in a row, then this may be the type of learning for you.</p>
<p>Start your class on any of the red days.</p>
<p>You may take the 18 Chapters in any order you choose.</p>
<p>You may attend a full day or a half day.  The days in red are &#8220;full, 10-hour days&#8221;</p>
<p>You must complete 9 full days or 18 half days, or a combination of both in order to get in your 90 hours.</p>
<p>You may only get study credit for the scheduled days you spend in the classroom with Kathy</p>

<p>Let&#8217;s put the first issue on the table:  the form to be filled out by the Monitor/Auditor</p>

<p>Many Instructors are unaware that the Monitor/Auditor is evaluating the content or the knowledge of the Instructor/Educator of the content.  The issue here is:  What qualifications do the Monitor/Auditors have to judge the content or the knowledge of the Instructor/Educator?</p>
<p>Would auditing the content best be done by another Instructor/Educator?</p>
<p>Currently the ADRE will not allow other Instructors/Educators to be a Monitor/Auditor.</p>
<p>If the purpose is to protect the public by ascertaining that the information being given during continuing education courses is accurate, shouldn&#8217;t the auditor be from the ADRE or another school?</p>
<p>Hmm&#8230;rate the knowledge of the Instructor/Educator.   Very subjective and unless the monitor/auditor in the class is experienced and knowledgeable in the subject matter, wouldn&#8217;t it be difficult to rate the knowledge of the subject Instructor?</p>

<p>Many Instructors and Educators are primo in all categories, while others are learning and gaining their sea legs.  Most only want to be good, better, and the best they can be.  It is the hope of this author that the ADRE will realize that auditing/monitoring the way they are doing it, especially without allowing the Instructor/Educator a copy of the report, does not help education.  It may help regulators, but in no way does it help an Instructor/Educator become more proficient in their chosen profession.</p>

<p>Seller Financers—3-Property Exclusion</p>
<p><em>This exclusion applies to “persons” as defined broadly under TILA to include not only “natural” persons but</em><i> <em>also a wide range of organizations such as corporations, partnerships, proprietorships, estates, and trusts. To</em> <em>be excluded from the definition of loan originator using the 3-property exclusion, you must meet all of the</em> <em>following criteria:</em><br />
<em>i. The person provides financing for the sale of 3 or fewer properties in any 12-month period. Each</em> <em>property must be owned by the seller and serve as security for the financing.</em><br />
<em>ii. The person has not constructed, or acted as construction contractor for, a residence on the property</em> <em>in the ordinary course of business of the person.</em><br />
<em>iii. The person provides seller financing that meets the following requirements:</em><br />
<em>A. The financing is fully amortizing (no balloon mortgages or negative amortization).</em></i></p>
<p><i><em></em></i>B. The person determines in good faith that the consumer (buyer) has a reasonable ability to repay.The regulation does not require documentation of the determination, which significantly ease the regulatory burden, though CFPB points out it may be a good idea in the case questions arise whether the seller made the determination. CFPB’s Official Interpretations of the regulation <em id="__mceDel" style="font-size: 13px; line-height: 19px;"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel" style="font-size: 13px; line-height: 19px;">provide guidance on how a seller could make the <b>determination that the buyer has a reasonable ability to repay. </b>This could include considering earnings as evidenced by payroll or earning statements, W-2s, etc.; other income from a federal, state, or local agency providing benefits and entitlements; and/or income earned from assets (such as financial assets or rental property).  The value of the dwelling may not be considered as evidence of the buyer’s ability to repay.   </em></em></em></em></em></p>
<h3><em id="__mceDel" style="font-size: 13px; line-height: 19px;"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel" style="font-size: 13px; line-height: 19px;">The Seller may rely upon copies of tax returns.  </em></em></em></em></em></h3>
<p><em id="__mceDel" style="font-size: 13px; line-height: 19px;"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel" style="font-size: 13px; line-height: 19px;"></em></em></em></em></em><em id="__mceDel" style="font-size: 13px; line-height: 19px;"><em id="__mceDel" style="font-size: 13px; line-height: 19px;"><em id="__mceDel"><em id="__mceDel"><em id="__mceDel">C. The financing has a <b>fixed interest rate</b> <b>or</b> an <b>adjustable interest rate that is adjustable after 5 or more years</b>. If it has an adjustable rate, it must have reasonable annual and lifetime limits on rate increases and provide for the rate to be determined by the addition of a margin to an index rate based on a widely available index such as indices for U.S. Treasury securities or LIBOR.  CFPB’s Official Interpretations note that an annual rate increase of up to 2 percentage points is reasonable. A lifetime cap of 6 percentage points, subject to a minimum floor and maximumceiling up to any applicable usury limit, is reasonable. These <b>“safe harbors” are not mandatory</b>, but sellers would be wise to adopt them.</em></em></em></em></em></p>

Seller Financing—1-Property Exclusion<br />
This more flexible exception applies only to a more narrow definition of “persons” (only natural persons, estates, and trusts) that sell only 1 property in a 12-month period. The exclusion is not available to other organizations, such as corporations, partnerships, or proprietorships. To be exempt from the definition of loan originator using the 1-property exclusion, you must meet the following criteria:<br />
i.<b> </b><strong>The person provides financing for the sale of only one property in any 12-month period</strong>. The property must be owned by the seller and serve as security for the financing.<br />
ii. The person has not constructed, or acted as construction contractor for, a residence on the property in the ordinary course of business of the person. (This is the same requirement as applies for the 3-property exclusion.)<br />
iii. The person provides seller financing that meets the following requirements:<br />
A. The financing has a repayment schedule that does not result in negative amortization. A<br />
balloon mortgage is permitted. (NAR sought relief from the prohibition against balloon mortgages.)<br />
<span style="font-size: 13px; line-height: 19px;">B. The financing has a fixed interest rate or an adjustable interest rate. <p>Sadly, owner financing was NOT the reason for our housing decline, but Dodd-Frank included it for whatever purpose.  Perhaps the banking industry thought many owners would choose to sell their homes without the use of a lender&#8230; who knows.</p>
<p>As a professional real estate agent, this will be an issue for resales and the broker needs to be in the loop and knowledgeable about Dodd-Frank.  Risk management would dictate that brokers have a policy in their manual about the new rules.</p>

<p>In the late &#8217;80s, subagency was still the way agents, buyers, and sellers interacted&#8230;but the times were changing.</p>
<p>In Flagstaff, I was new to the business and practicing real estate through Arizona Mountain Properties.  My career was launched and my transaction numbers were skyrocketing!  Then came a client who changed the way I did business.</p>
<p>Becky Payne, who is currently an owner of Century 21 at the Flagstaff Country Club, asked me to find her a lot so she could build a house.  Why was Becky special?  She was my best friend.</p>
<p>Understand, at that time, subagency required me to represent the seller in any transaction&#8230; that&#8217;s how we got paid.  It meant that I needed to disclose all material information to the seller about the buyer.  Since Becky had just gone through some very difficult times, I was concerned about my duty to let the seller know confidential and private information I had concerning Becky..  We had found a lot&#8230;</p>
<p>I went to my broker, Phyllis Murray, and told her I wanted to represent Becky.</p>
<p>As a good broker, she asked how we would get paid.</p>
<p>I responded:  &#8221;Same as we have been getting paid.  The only difference will be that I represent Becky and not the seller.&#8221;</p>
<p>Phyllis just smiled and said:  &#8221;Go talk to the other agent and if there is no problem, do it.&#8221;</p>
<p>I called the other agent who knew both Becky and me.  She said:  &#8221;No problem.&#8221;</p>
<p>It was the beginning of buyer representation in Flagstaff.</p>
<p>At the same time, Curtis Hall was creating his buyer representation in Phoenix&#8230; and history was being made.  Curtis and I soon got to know each other and to this day we are kindred spirits and share that special bond.  We didn&#8217;t allow tradition to stand in the way of change.  Change that has benefited buyers throughout Arizona.</p>
<p>So when you look for someone to assist you in the purchase of a property, ask about  buyer representation.  It may be assumed that the agent you choose will represent your best interests, but ask them anyway.  Ask them how they will represent your best interests.</p>
<p>If you are satisfied with the answers, sign the buyer broker agreement, and begin your real estate journey.  A good buyer representative will make a huge difference in the way your transaction unfolds.</p>
